AUGUSTA COUNTY, VA (Rocktown Now)- On November 23, 2023, the Augusta County Sheriff’s Office informed the public about the arrest of Sergeant William Mikolay by the Virginia State Police regarding an incident that occurred in Albemarle County on September 29, 2023. At the preliminary hearing on February 29, 2024, the Albemarle County Commonwealth Attorney dismissed charges against Adam Ryan Martin. However, the Albemarle County Commonwealth Attorney chose to proceed with charges against Sergeant Mikolay.
On Thursday, February 6, 2025, Sgt. William Mikolay appeared in Albemarle County Circuit Court. The Commonwealth has elected to dismiss the felony malicious wounding charge. Sergeant Mikolay entered an Alford plea, maintaining his innocence, to the misdemeanor assault and battery charge, which has been taken under advisement for 12 months. This charge will be dismissed at the conclusion of that period, pending compliance with court conditions. Sheriff Donald Smith requested the transcripts from today’s hearing and will release the documents when they are available.
“At this time, Sergeant Mikolay remains on paid administrative leave, as our internal investigation into the incident is ongoing,” said Sheriff Donald L. Smith.
