A Freedom of Information lawsuit filed against former Albemarle Commonwealth’s Attorney Denise Lunsford has been settled, although attorney Matt Hardin says his client essentially had to settle for less. Hardin’s client, Tyler Pieron of Gordonsville, asked for records that involve the Mark Weiner case and communications between Lunsford and onetime Scottsville District supervisor Chris Dumler.
Hardin says Lunsford (pictured) agreed to produce the records, but told him it would take five weeks and $3200 to cover retrieval and printing. He says she eventually sent some of the requested records but not all, and that they were accompanied with a bill. The amount was smaller that the original amount , but Martin says his client had never agreed to make any payments.
Albemarle’s new Commonwealth’s Attorney, Robert Tracci, has waived the fee. Hardin says he was told the county was unable able to produce all records because of a recent computer crash. Hardin says he’s spoken with several IT experts, who told him hard drives don’t crash anymore.
“It’s certainly a concern, and I think that we need to take it very seriously,” Hardin told WINA’s Rob Schilling. “I think county boards of supervisors, should look into it and should probably take steps to make sure that their technology doesn’t crash again because, in this case, the records are gone but there are other records being generated every day that we want to preserve.”
