Virginia’s Same-Sex Marriage Case Going To U.S. Supreme Court

Attorney General Mark Herring will petition the U.S. Supreme Court to hear the case challenging Virginia’s same-sex marriage ban. Herring’s office says he will formally ask the justices to hear the case and “definitely settle the constitutional issues for the Commonwealth and the rest of the country.” The announcement comes four days after the Clerk of Circuit Court in Prince William County requested a stay of last week’s ruling from the U.S. 4th Circuit Court of Appeals, which declared the state’s same-sex marrriage ban is unconstitutional. Just hours before Herring’s announcement, Utah formally petitioned the U.S. Supreme Court to hear that state’s same-sex marriage ban.
