State Responds To Daly Lawsuit Against ABC

The state is asking that Elizabeth Daly’s $40 million lawsuit be dismissed. Daly is the UVA student who sued both the state and the seven ABC agents who surrounded her SUV when they thought the sparkling water she had was alcohol. The state says in a brief filed Tuesday that the lawsuit seeks a “shocking level of damages.” The brief goes on to say that the agents’ response was legally justified and protected by qualified immunity. The incident happened outside the Harris Teeter in Barracks Road Shopping Center in April 2013.
