Judge Delays Sentencing For Mark Weiner

An Albemarle Circuit Judge has delayed a sentencing hearing for a onetime grocery store manager who’s been convicted of abduction. Judge Cheryl Higgins wants a sex-offender evaluation of 53-year-old Mark Lawrence Weiner (pictured) of Barboursville. Weiner’s new lawyer says a request for that type of mental evaluation should have surfaced before a Tuesday hearing. Steve Benjamin says Albemarle Commonwealth’s Attorney Denise Lunsford has not given him the access he needs to police records and other information about Weiner. He says his client has been behind bars for nearly 600 days for something he did not do. Lunsford says her office has provided all the files Benjamin should need. A jury has convicted Weiner of abduction with the intent to defile. Higgins will set a new sentencing date on August 4th.
